Penalties severe for underage drinking and driving in TN

No Memphis resident wants to face a DUI charge, but for those who are underage the penalties can be severe. Prosecutors aggressively pursue drunk driving charges and the public generally backs their vigor. Underage drivers who have been arrested for underage drunk driving can face criminal charges and fines.

Young people who are under the age of 21 in Tennessee and caught driving after drinking can face underage driving under the influence charges. Underage people are subject to a stricter blood alcohol content than of-age drivers. Underage drivers who have more than a .02 percent BAC can face an underage DWI charge. Those who are between 16 and 18 face penalties of having their license suspended for a year and a $250 fine. The court may also inflict community service and charge the youth for court costs.

If the person is between 18 and 21 they are subject to a Class A misdemeanor. The penalties may include license suspension or revocation for a year and a $250 fine. They are also not eligible for a restricted driver's license. The court may also impose community service and court costs.

Underage drivers who are facing a DUI charge may want to contact a legal professional skilled in criminal defense. An attorney can aggressively defend the charges against the young person. They can review arrest records, review the circumstances surrounding the offense, including weather and health conditions, and review the equipment used to determine blood alcohol content. Protecting your future is very important and a criminal defense attorney can work hard to make sure your voice is heard.
